How is overtime calculated under federal law?

The Fair Labor Standards Act (FLSA) requires non-exempt employees to receive overtime pay at 1.5× their regular rate for hours worked beyond 40 in a workweek. The "regular rate" includes hourly pay plus non-discretionary bonuses, shift differentials, and certain other compensation.

Which states have daily overtime rules?

California: 1.5× after 8 hours/day, 2× after 12 hours/day. 7th consecutive day: 1.5× first 8 hours, 2× thereafter.
Alaska, Nevada, Puerto Rico: 1.5× after 8 hours/day.
Colorado: 1.5× after 12 hours/day.
Oregon (manufacturing): 1.5× after 10 hours/day.

Are salaried employees eligible for overtime?

Yes, unless they meet specific exemption criteria. The FLSA "white collar" exemptions (executive, administrative, professional, computer, outside sales) require both a salary basis test (≥$684/week as of 2024) AND a duties test. Job titles alone don't determine exemption status.

Must bonuses be included in the overtime rate?

Non-discretionary bonuses (production, attendance, quality, safety bonuses promised in advance) must be included in the regular rate calculation. Discretionary bonuses (holiday gifts, unannounced rewards) are excluded.

Can my employer give comp time instead of overtime pay?

Private sector employers generally cannot substitute compensatory time off for overtime pay — this violates the FLSA. Public sector employers may offer comp time under specific conditions (1.5 hours comp time per overtime hour, with employee agreement).
